contracts and intellectual property 1

Hey what’s up? Here is the first assignment. I attached the E-Commerce Payment Mechanisms and General Contract Clauses just in case they wouldn’t open.

5.2 – Assignment: Case Study – Direct Payment Systems

Sally needs you to research a hot topic related to her invention she is working on. It’s a payment system that allows customers to order and pay at the table with their mobile device. The device will also enable customers to order and pay for takeout and schedule delivery or pickup. She wants to know if there are any laws that control the use of the device payment system.

Your Assignment

After completing the text readings and conducting an Internet search on laws that regulate restaurant direct payment systems, write up your research on an Issue Spotting Memo that includes a brief synopsis of the applicable laws and legal issues. She also wants to know if the invention is solely hers or if the company can claim credit too. Include what the textbook covers about potential liability for the restaurant related to the invention’s use. Sally also has this helpful document on E-Commerce Payment Mechanisms (DOCX) to help with this assignment.

Provide Sally with information directed at how to determine the ownership of Intellectual Property between a company and an employee. Here is an example of some General Contract Clauses (PDF) that may be helpful.

1. “Exempt” employees are not entitled to a minimum wage or overtime under federal and state law.

First, in your own words, identify the three requirements that must be met for an employer to classify an employee as “exempt.” Then, do some research into “misclassification.” Sometimes,

employers misclassify intentionally and sometimes they do so mistakenly. Explain the common

motive employers have when they misclassify intentionally and the common mistake employers

make when they misclassify mistakenly. Finally, what penalties might an employer face for

misclassification?

2. Many hospitality employees in Nevada receive tips as part of their compensation. First, in your

own words, describe the difference between: 1) “tip crediting” and 2) “tip pooling.” Then, tell me

if such actions are lawful in Nevada. Finally, do you agree with the law regarding tips in Nevada?

3. Many hospitality employees in Nevada are asked by their employers to be “on-call”for work, meaning there is no guarantee of work, only the possibility of work if the employer calls. There is legitimate debate about whether employees should be compensated for being on “on-call” whether they get called into work or not. Do some research into the debate. Then, tell me what factors a court may consider when faced with the argument that an employer should pay employees who are “on-call.” What factors weigh against paying for “on-call” time? What is your opinion on the subject?

introduction conclusion and summary

Rewrite it into a dynamic, attention-getting conclusion that can pull together an essay on the death penalty, regardless of your own opinion on the issue. You may keep any of the original words/sentences that you want, in any order, but you may also delete/reorder/add words as necessary. You must write at least 7 sentences for full credit. You will may need to create your own thesis to “restate” if you don’t feel there is a restated thesis here. See West Guide Ch. 13 for specific techniques.

In conclusion, as I have proved, the death penalty is obviously still effective. It doesn’t matter what others say if it is a law. Therefore people can have their opinions; I don’t care.

Introduction Exercise

Critique the following underdeveloped introduction and suggest some items the essay writer can use to develop it. There may be several errors other than brevity. Rewrite it into a dynamic, attention-getting introduction that can generate an entire essay on spanking as discipline for children, regardless of your own opinion on the issue. You may keep any of the original words/sentences that you want, in any order, but you may also delete/reorder/add words as necessary. You must write at least 7 sentences for full credit. See West Guide Ch. 12 for specific techniques.

Some people think it’s okay to spank their children for punishment. Others disagree. Spanking children can be harmful because it can cause psychological trauma, it can leave lasting physical scars, and there are better ways to teach discipline. This essay will explore all aspects of spanking.

history response 13

Instructions: For response 1, respond thoughtfully. Just saying “I agree” or “I disagree” does not constitute a thoughtful response. They need to be substantive to promote further discussion, new ideas, or questions and are approximately 150-200 words (1 paragraph) in length. Short comments, such as “Good point,” information not applicable to the historical context of the assigned topic, and non-topic personal interactions do not apply.

1. How did urban industrialization affect Americans’ lives outside of the workplace?

Although there were several new technology and invention, I believe that the upgrade in transportation was the most impactful. The creation of the railway was a source of only long distance travel, “city to city”so it was useless when it came traveling with in city limits. There were also carriages that would get pulled by a horse called an Omnibus. The omnibus was an essential way of moving around but only in small towns where it was not crowded. It did not fit a lot of people and was powered by a horse. The problem with that was that the horse had needs like drinking water, dumping out his body wastes or taking breaks to rest. transportation was important in the time of industrialization because people had to get to work, go shopping, to the grocery store etc. Until 1887 when Frank Sprague invented the electric trolley. Many will claim that electricity was the most important finding in human history and I can agree to that because it powered everything else that was invented. with that being said the trolley was powered by electricity but it maintain that same concept as the omnibus. It was as great improvement to the transportation industry because it allowed people to move throughout the entire day. The only problem that was left was it was not possible to use in the cities due to the significant amount of people. A group of city workers came up with the idea to elevate the trains lines in the streets, this was called L-Trains. There were several incidents in the usage of the trolley as it became adapted by several cities, later on the trains were submerge to the underground like we see today with the subways. Transportation has and will always be an issue whether if it traffic or the excessive release of carbon in the air, it is always an important part in our everyday life. I believe that the rate of growth in the 1800’s without the improvement of transportation would be critical. with the trains operating ,work places extended their hours and with that that came the increase of production.
